DUI FAQ

What does blood alcohol content/concentration mean?

Blood-alcohol concentration (BAC) is the level of alcohol in the bloodstream from drinking alcoholic beverages.  BAC readings are used in court as evidence in drunk-driving cases. The most common methods of measuring a person’s BAC are breath tests and blood tests.  A person with a BAC of .08 or higher is considered to be over the legal limit and is intoxicated.

Are blood and breath tests always accurate?

Although blood and breath tests are good ways of determining a person’s BAC, they are not always 100% accurate.  There are variables with each testing method that have been known to lead to results that are inaccurate or inflated.  If certain weather conditions are present during the implementation of a breath test, or if the test subject has a health condition, the results of the breath test may not be correct.  If a blood sample is improperly stored or is not drawn properly, the results of a blood test could also be false.  An Atlanta DUI lawyer from our firm will examine your blood or breath test to find out if something caused an inaccurate BAC result.

If I am found guilty of DUI, will I lose my license?

Driver’s license suspension is a common part of being convicted of drunk driving.  A separate proceeding called a DMV hearing will be held by the department of motor vehicles to determine whether or not a person’s license will be suspended after being arrested for DUI.  To give yourself the best chance at retaining your driving privileges, you should speak with an Atlanta DUI lawyer at Ross & Pines, LLC.

Will my auto insurance premiums automatically increase if I am arrested for drunk driving?

Every insurance company is different, so it is necessary to contact your insurance company to see what their policy is.  More often than not, people who are convicted of DUI are seen by insurance companies as high risk drivers, which causes an increase to their premiums.  To avoid conviction and the resulting insurance penalties, you need to hire an experienced attorney to handle your case.
