Georgia DUI laws can be violated in two ways.  First, driving or being in control of a motor vehicle with a blood alcohol content of .08% or greater.  If a commercial vehicle is used, the limit is .04% and if the person is under 21, the limit is .02%.  Second, inferior driving observed by a police officer before a traffic stop or collision, and the determination that the person is under the influence.  An arrest can be made even with a BAC below .08%.  It is imperative that you consult with an attorney from our firm as soon as possible after your arrest so that we can separate the facts, find any errors in your case, and come up with the best resolution for you.  

Penalties in First Time DUI Cases

First time offenders who have NOT been convicted of DUI with injury are guilty of a misdemeanor offense.  Penalties in Georgia can include:

  • $300-$1000 fine
  • 10 days-one year jail, can be stayed or suspended; at least 24 hours jail with a BAC of .08%
  • 40 hours or more community service with .08%, 20 hours with BAC under .08%
  • Risk Reduction Program for alcohol/drugs
  • One year probation, less jail time
  • Up to one year driver's license suspension, may be eligible for a Limited Driving Permit
