The penalties In Georgia for DUI drug and DUI alcohol charges are essentially the same, but the laws are somewhat different.  The DUI drug law is violated by driving or being in control of a moving vehicle while under the influence of any drug to the extent that it is less safe to drive.  Another violation is incurred by being under the intentional influence of any glue, aerosol, or other toxic vapor to the same extent.  This "less safe to drive" law is sometimes difficult to prove, with circumstantial evidence like the police officer's observations together with results of urine and blood tests used to help the prosecution prove their case.
