Understanding the DUI Court Process

The DUI court process begins when a person is arrested for drunk driving after a law enforcement officer notices signs of intoxication. These signs could come from simple observations, field sobriety tests, breathalyzer tests, or blood tests. Once the officer has probable cause, they can legally arrest a person for driving under the influence. After being taken into custody, the driver will be released on bond, held in custody until the arraignment, or released on their own recognizance.

The next step in the DUI court process is the arraignment. During the arraignment, a judge will advise a driver of the pending charges and they will be read their rights. It is during this point that the driver will enter a plea of either guilty or not guilty. It is extremely important to have an attorney representing you during this time because they will advise you how to proceed. If entering a guilty plea is appropriate for your situation, your Atlanta DUI lawyer will help negotiate a lesser sentence. If entering a plea of not guilty is in your best interests, your DUI defense attorney will help prove your innocence at court.

Next Step of Defending Against DUI Charges in Atlanta

Submitting pretrial motions will be the next step in the DUI process. Motions to suppress evidence, discovery motions, motions to dismiss, or other motions may become necessary for your case and your Atlanta DUI attorney will help you with this. After this, the trial will take place. Trial is the final stage of the DUI process when the defense and prosecution examine witnesses, cross-examine opposing witnesses, present evidence, give arguments. A judge will then apply the facts of the law to the case or will give the jury instructions on how to do this.

An Atlanta DUI lawyer from Ross & Pines, LLC will help you through each and every step of the UI process. With an aggressive defense attorney on your side, you will have much more confidence as you embark upon this process.  Having your lawyer beside you every step of the way will improve your chances of successfully resolving DUI charges.
