Consequences for Breathalyzer Refusal

In the state of Georgia, individuals who refuse to take Breathalyzer tests will run a risk of having their driver’s licenses suspended for one to five years. The attempt to take away a person’s driving privileges will occur before the criminal proceeding, and in most cases will be automatically entered unless an appeal letter is filed within 10 business days of the date of arrest. Filing an appeal will permit a postponement and may even prevent suspension altogether, that is until the verdict of the trial. At the least, a "stay" of any proposed suspension will not occur until you have had a chance to have a hearing with a judge.
